Bert got in the patrol car to transport me to the police station, and I informed him that he was supposed to be upholding the law, not breaking the law by committing unlawful detainers and kidnappings. He then transported me to the Aurora police station and put me in a holding cell with a towel to get the mace off of me. After a few minutes, the officers came to the door with a fireman that had a pair of bolt cutters. The officers then had me to put my hands through the cell door so the fireman could get a grip of the handcuffs with the bolt cutters but when he tried to cut them off that put a lot of pressure on my wrists and he could not squeeze the bolt cutters hard enough to break or cut the hand cuffs. Patrolman Jakes apparently followed the Aurora officers to the police station and instructed them how to get the handcuffs off of me. He also told them to take several pictures in case they needed it for later use.
Since the fireman could not cut off the handcuff with the bolt cutters, he then tried a sawzall while I was still in the cell but that shook the handcuffs instead of cut them so the patrol officer had the city officers take me into the fire department maintenance bay where he had taken the sawzall with a metal cutting blade on it and then positioned my arm in the shop vise and clamped down on the handcuffs so they would not shake and then he started cutting the hinge of the handcuff.
The Highway patrol officer instructed them to put a glove or the finger of the glove through and between the handcuff so that the metal shavings would not burn me when they fell off of the hinge, and to protect my wrist in case the sawzall slipped. After a few tries, this idea worked and the sawzall cut the hinge into but it was still hard for them to pry the single handcuffs apart enough to get the key in the lock. This style of handcuff only let the key enter one direction and since it was a sturdy hinge style they could not twist or spread the handcuff without cutting it first.
After a little soap and maneuvering the handcuff they got it spread enough to get the key into the lock and unlock the handcuff. Then they gave me another towel and put me back into the cell to clean up better since I had soap on me now. I stayed in the cell about another 30 minutes before three officers came in an opened the cell door for me to be booked into the facility. After I was booked and fingerprinted, they called the chief since I would not bail out and he informed them to release me after processing.
Before I was able to leave, Bert gave me my wallet back and I saw that I had $35.00 dollars missing which I protested and he claimed that I didn’t have any more money in my wallet than what was there, but I knew better. He had stolen my money for the crime he instigated while wearing a badge. He then filled out a release form, and I refused to sign it stating that I was unlawfully detained, in other words, kidnapped. Bert just signed the release form as defendant refused to sign then I was released. By this time, I had been at the police station about three and a half hours. At no point in time, did they read me my Miranda warning although the State patrolman questioned me about the incident.
I was told that the local gas station had towed my vehicle, and that they were not sure where my vehicle had been towed so I walked from the police station to the gas station to see if it was in their facility, but it wasn’t there so I walked home where I found it sitting in my driveway. Once I got into my house, I went and changed, took a shower to get rid of the mace that was still on me. This was an infuriating situation and I was quite upset about these tyrants assaulting me for their failure to know the law. From past experiences I knew it would not do any good to file charges with the County prosecutor as he condones criminal behavior by those in uniform.
The next day, when I went to the gas station, I found out that officer Richy and Wilson had done an unlawful search of my vehicle. I also learned from the tow truck driver (Tiny Asbury) that one of the officers had threatened to break out all the windows of my vehicle because I took a stand against their tyranny. He told them that he was a witness if they did anything like that and that, they would pay or something to that effect.
On October 12, information on this incident was filed with the Lawrence County prosecutor and he filed criminal charges against me for “Resisting arrest”, and “Assaulting a police officer”. When I was taken before the judge, I told him to show me where the law gave the officer the authority to arrest a person for failure to sign a traffic citation. I then told the judge that he couldn’t, because the law did not exist, and therefore, the officer was at fault for instigating the assault against me. I refused to plea since I had not committed any crime. I also informed the judge that this was just another manufactured crime to try to convict an innocent individual of crime that the officer initiated and committed. The judge (Stoffer) recused himself, and Judge Micky was assigned to the case, but he recused himself because he was my father’s attorney prior to becoming a judge. This meant that this case had to be reassigned.
